The short answer
Under the 2018 Farm Bill, hemp is federally legal as long as the finished product contains less than 0.3% Delta-9 THC by dry weight. Hemp-derived CBD gummies meet this definition and are legal to purchase, possess, and ship in all 50 U.S. states.
The Farm Bill removed hemp from the federal Controlled Substances Act, which is why a product that would be illegal as 'marijuana' can be perfectly legal as 'hemp' β same plant family, different legal category.
The 0.3% rule explained
0.3% Delta-9 THC by dry weight is the line between 'hemp' (legal) and 'marijuana' (federally controlled). A hemp gummy that tests under this threshold is legal at the federal level regardless of how much CBD or minor cannabinoid content it carries.
This is why reputable brands publish third-party Certificates of Analysis (COAs) β to document compliance batch by batch. JGO's COAs are published publicly for every product.
State-level exceptions to watch
Standard hemp-derived CBD gummies (isolate, broad-spectrum) are legal in all 50 states. Where things get more nuanced is with newer cannabinoids like Delta-8, Delta-10, THC-O, and HHC, which a small number of states have specifically restricted even though they are hemp-derived.
| Product type | Federal status | All 50 states? |
|---|---|---|
| CBD isolate gummies | Legal (Farm Bill) | Yes |
| Broad-spectrum hemp gummies | Legal (Farm Bill) | Yes |
| Full-spectrum hemp gummies (<0.3% Delta-9) | Legal (Farm Bill) | Yes |
| Delta-9 hemp gummies (<0.3% by dry weight) | Legal (Farm Bill) | Yes in most states, restricted in a few |
| Delta-8 / Delta-10 / HHC hemp gummies | Legal federally | Restricted in ~15 states |
Can hemp gummies be shipped across state lines?
Yes. The 2018 Farm Bill explicitly authorizes interstate commerce for compliant hemp products. Carriers like UPS, USPS, and FedEx will ship hemp-derived CBD products legally.
The practical caveat is that if you order a cannabinoid your state has separately restricted (most commonly Delta-8), the seller may decline to ship to your state. Jolly Green Oil maintains current state compliance lists and ships accordingly.
What about drug tests?
Federal legality does not automatically mean safe for drug testing. Full-spectrum hemp gummies contain trace Delta-9 THC (<0.3%), which on rare occasions at heavy repeated use can show up on very sensitive panels. If you are drug-tested at work, choose broad-spectrum or isolate to eliminate the risk.
What about kids?
Hemp gummies are intended for adults 21 and older. This is an industry best-practice age restriction, not a federal requirement β but every reputable brand enforces it, and Jolly Green Oil does too. Keep hemp gummies out of reach of children and pets.
